Service Agreement & Terms of Use
Momma Eval

By purchasing, enrolling in, or participating in Momma Eval (“Program”), you (“Participant”) agree to the following Terms of Use and Service Agreement:
1. Fitness & Educational Services
Momma Eval is a fitness and educational assessment service provided by marypeckcoaching for informational, educational, and physical development purposes only.
Momma Eval is designed to evaluate areas such as movement, strength, core function, breathing mechanics, pelvic floor function, and other factors related to training during pregnancy and/or postpartum, as applicable.
Individual results are not guaranteed and will vary based on each Participant’s effort, implementation, initial physical condition, medical history, and unique circumstances.
2. Payment Terms
Momma Eval requires a one-time payment of $300.
There are no recurring payments, monthly subscriptions, or ongoing payment commitments associated with Momma Eval.
By submitting payment, Participant authorizes a one-time charge of $300 to the selected payment method.
3. No Refund Policy
All sales are final.
Due to the individualized nature of the assessment, preparation involved, and time reserved for the Participant, no refunds, cancellations, credits, transfers, or chargebacks will be permitted once the service has been purchased, including failure to schedule, attend, participate in, or complete the evaluation.
4. Intellectual Property
All Program content and materials provided as part of Momma Eval, including but not limited to exercise recommendations, assessment materials, training recommendations, videos, worksheets, templates, downloads, graphics, and written materials, are the exclusive property of marypeckcoaching and may not be copied, reproduced, shared, distributed, republished, or resold without prior written consent.
5. Participant Conduct
Participants agree to maintain respectful and professional behavior during the evaluation and within any related communication or community spaces.
marypeckcoaching reserves the right to discontinue services for disruptive, abusive, inappropriate, or harmful conduct.
6. Fitness & Medical Disclaimer
You should always consult your physician or other healthcare provider before changing your diet, beginning an exercise program, or making changes to your physical activity, particularly during pregnancy or postpartum.
I understand that there is a risk of injury associated with participating in and using Momma Eval and any exercise, movement, training, or recommendations provided as part of the service.
Momma Eval is intended for educational, informational, and fitness purposes only and does not constitute medical, legal, psychological, or physical therapy advice or treatment.
Momma Eval does not replace evaluation, diagnosis, or treatment by a licensed healthcare provider.
7. Assumption of Risk & Limitation of Liability
I hereby assume full responsibility for any and all injuries, losses, and damages that I may incur while participating in Momma Eval or implementing any exercise, movement, training, or recommendations provided through the service.
I hereby waive all claims against marypeckcoaching, its instructors, coaches, contractors, or partners, individually or otherwise, for any and all injuries, claims, or damages that I might incur in connection with participation in Momma Eval or use of any materials or recommendations provided through the service.
To the fullest extent permitted by law, marypeckcoaching shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to participation in Momma Eval or use of any materials or recommendations provided as part of the service.
8. Agreement
By completing checkout and purchasing Momma Eval, Participant acknowledges that they have read, understood, and agreed to these Terms of Use and Service Agreement, including the one-time $300 payment, no-refund policy, fitness and medical disclaimer, assumption of risk, and limitation of liability provisions.
